Problem with tc4200 pen

I recently purchased a tc4200 but i have one issue with it. The pen does not
hover when it's 3/4 from the screen but it seems its constantly on left click
making it very difficult to use (ie starts making a box when pointing to
desktop / move the icons)
I have tried reinstalling HP drivers for HID and also the latest wacom
4.95-6 but the problem still persists

I feel it's likely to be hardware related but nt sure whether it's the pen
itself or the screen
Your help is much appreciated

Specs
Win XP Tablet SP2 with all the latest updates
P Centrino 1.8
1G RAM

If your Tablet PC is new, I would call the support folks and tell them the
situation. The problem may be hardware, i.e., the digitizer, but they'll be
able to determine it for you.

As I said in the HP forum already:
Contact HP service an have the machine serviced. It's under warranty,
so let the manufacterer do his job.
